By creating an account, accessing, or using our Platform, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference into this agreement. Please read these documents carefully.

Welcome to Viaje! These Terms of Use (“Terms”) govern your access to and use of the Viaje tourism web application, platform, and services (collectively, the “Platform”), operated by Pinkberry BPO Solutions Inc. (“Viaje,” “we,” “us,” or “our”) under a Public-Private Partnership arrangement with the Municipality of Daraga, Albay Province, Philippines. Our mission is to innovate travel and promote Daraga, Albay, as a premier tourism destination by connecting you with local tourism service providers (“Merchants”).

  1. The Viaje Platform

    Viaje is a digital platform that enables you to discover and book tourism-related services, including but not limited to accommodations, tours, activities, tickets, and vehicle rentals, offered by independent, third-party Merchants in Daraga, Albay.

    You acknowledge that Viaje is a technology platform and not a provider of tourism, transportation, or accommodation services. The Merchants are independent contractors and are not employees or agents of Viaje. All services are provided directly by the Merchants, who are solely responsible for honoring your bookings and for the quality, safety, and legality of the services they provide.

  2. User Accounts

    To access most features of the Platform, you must register for an account. You agree to:

    • Provide accurate, current, and complete information during the registration process.
    • Maintain the security and confidentiality of your account password.
    • Notify us immediately if you suspect any unauthorized use of your account.
    • Be solely responsible for all activities that occur under your account, whether or not you have authorized them.

    The Platform is not intended for use by individuals under the age of 18.

  3. Bookings and Payments

    1. Bookings: When you book a service through the Platform, you are entering into a direct contract with the Merchant. You agree to pay all fees and charges associated with your booking as displayed at the time of purchase.
    2. Payments: All payments are processed through our secure third-party payment gateway. Viaje does not store your full credit card or payment details. By providing payment information, you authorize us and our payment processor to charge your selected payment method for the total amount of your booking.

      Dragonpay Direct bank transfers are available for BDO Unibank and Bank of the Philippine Islands account holders. For other banks, payments are processed through a third-party payment gateway. Additional options include e-wallets and over-the-counter payment facilities. HMAC signature verification, HTTPS

      This list may be updated if additional payment gateways are integrated. Any changes will be reflected in the updated Terms.

    3. Receipts and Convenience Fees (Upon request)

      When you book a service through the Viaje platform, you will receive two separate receipts:

      • An official receipt from the Merchant for the base service cost (the actual price of the accommodation, tour, rental, etc.).
      • A digital service receipt from Viaje (covering the convenience fee, which supports the technology, customer support, and platform maintenance that make your transaction seamless and secure).

      Additional receipt provisions:

      • Combined Bookings: If your checkout includes services from multiple Merchants, Viaje will itemize the convenience fees per service in the service receipt, available upon your request.
      • Legal Compliance: Viaje and its partner Merchants comply with all applicable tax and receipt regulations, including those issued by the Philippine Bureau of Internal Revenue (BIR). You are entitled to request official receipts from both parties as outlined above.
  4. Cancellations, Reschedules and Refunds

    1. Cancellation

      • Users can initiate cancellation without incurring any cost if the payment status is still pending. However, once the payment has been credited, fees and other charges automatically apply.
    2. Reschedule of Booking

      • Reschedule More Than 72 Hours Before Service:
        Users may request to reschedule their booking more than seventy-two (72) hours before the scheduled service, subject to merchant availability. Rescheduling is allowed for the same package only and cannot be converted to a different service or package. Reschedule button is available in the transaction modal on your viaje wallet.
      • Reschedule Within or Less Than 72 Hours Before Service:
        Rescheduling requests made within or less than seventy-two (72) hours before the scheduled service are not allowed.
    3. Refund

      • Users who are eligible for a refund may initiate their request by filling out the refund form with the required details (Transaction ID, booked service, merchant, and booking date). The form can be accessed via the Refund button in the transaction modal on your viaje wallet.
      • No-Show: If a user fails to show up, the booking is considered forfeited and no refund will be issued. The merchant remains entitled to the booking value in accordance with platform settlement terms.
      • Refund Processing: Viaje is not responsible for any delays in refund processing caused by third-party payment gateways or financial institutions. Once Viaje has initiated the refund, the transaction is subject to the processing timelines of your bank or payment provider. For refund status updates, contact your bank or payment service directly. Viaje will provide transaction references upon request to facilitate follow-up.

    Promotional Bookings: All bookings made using a promotional code, discount, or special offer are strictly not eligible for cancellation, rescheduling, or refund under any circumstances.

  5. Vehicle Rental Services

    The Viaje Platform lists vehicle rental services from various operators. By booking a vehicle rental through the Platform, you specifically acknowledge and agree to the following:

    • Viaje is Not a Rental Operator: Viaje acts only as a facilitator and is not a party to your rental agreement with the vehicle operator.
    • User Assumes All Risk: Viaje does not inspect vehicles, verify operator licenses or insurance, or guarantee the safety or roadworthiness of any vehicle. You use all rental services at your own risk.
    • Limitation of Liability: Viaje expressly disclaims all liability for the condition of rented vehicles, the operator’s compliance with laws, or any accidents, injuries, damages, or losses arising from or related to your use of vehicle rental services booked through the Platform. The vehicle rental operator is solely responsible for all aspects of the service provided.
  6. User Responsibilities and Conduct

    You agree to use the Platform only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the Platform. Prohibited behavior includes, but is not limited to:

    • Providing false or misleading information.
    • Using the Platform for any commercial purpose without our prior written consent.
    • Harassing or causing distress or inconvenience to any person, including Merchants and other users.
    • Attempting to bypass our security measures or gain unauthorized access to any part of the Platform.
    • Uploading or transmitting malicious code, viruses, or any software intended to damage or interfere with the Platform.
    • Misrepresenting your identity or impersonating any person or entity.
  7. Data Privacy and Security

    Your use of the Platform is also governed by our Viaje User Privacy Policy (www.viajekita.com), which is incorporated into these Terms by reference. The Privacy Policy explains in detail how we collect, use, store, and protect your personal data in compliance with the Data Privacy Act of 2012 (Republic Act No. 10173) and applicable GDPR principles.

    Key data protections we implement include:

    • AES-256 encryption for data at rest and TLS 1.3 for all data in transit.
    • Role-Based Access Control (RBAC) and Multi-Factor Authentication (MFA) to restrict access to your data.
    • PCI DSS-compliant payment processing, your full card details are never stored.
    • Regular security audits, vulnerability scanning, and penetration testing.

    In the event of a data breach that affects your personal information, Viaje will notify affected users within 72 hours of confirmed discovery, in accordance with our Incident Response Plan and applicable legal requirements. Notification will be sent to the email address associated with your account.

  8. Intellectual Property

    All content and materials on the Platform, including the Viaje name, logo, text, graphics, software, and other files, are the property of Viaje or its licensors and are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Platform for your personal, non-commercial use.

  9. Disclaimers and Limitation of Liability

    THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. VIAJE MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE PLATFORM OR THE SERVICES OFFERED BY MERCHANTS, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

    VIAJE DOES NOT GUARANTEE THE QUALITY, SUITABILITY, SAFETY, OR ABILITY OF MERCHANTS. YOU AGREE THAT THE ENTIRE RISK ARISING OUT OF YOUR USE OF THE PLATFORM AND ANY SERVICE YOU BOOK REMAINS SOLELY WITH YOU.

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIAJE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR USE OF THE PLATFORM OR YOUR INABILITY TO USE THE PLATFORM; (B) ANY SERVICES PROVIDED BY A MERCHANT; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

  10. Indemnification

    You agree to defend, indemnify, and hold harmless Viaje and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Platform or your violation of these Terms.

  11. Termination

    Viaje may, in its sole discretion, suspend, disable, or terminate your account and your right to use the Platform at any time and for any reason, including for a breach of these Terms, without prior notice. We will not be liable for any loss or damage related to the suspension or termination of your account.

  12. Changes to Terms

    Viaje reserves the right to modify these Terms at any time. If we make material changes, we will provide you with notice through the Platform or by email. Your continued use of the Platform after any such change constitutes your acceptance of the new Terms.

  13. Governing Law and Dispute Resolution

    These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any dispute arising out of or in connection with these Terms that cannot be resolved amicably through good-faith negotiation within thirty (30) days shall be submitted to the exclusive jurisdiction of the courts in Daraga, Albay.
